Instruction and Information on the Right of Withdrawal
Physical Products
Provided the customer is a consumer within the meaning of Section 13 of the German Civil Code (BGB), they may, in the case of physical products, withdraw their contractual declaration within 31 days without stating any reasons in text form (e.g., by letter, fax, or email) or – if the goods are handed over to them before the deadline expires – by returning the goods. The period begins upon receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and not before the fulfillment of our information obligations pursuant to Article 246, Section 2 of the Introductory Act to the German Civil Code (EGBGB) in conjunction with Section 1, Paragraphs 1 and 2 EGBGB as well as Section 312g, Paragraph 1, Sentence 1 BGB in conjunction with Article 246, Section 3 EGBGB.
Digital Products
Provided the customer is a consumer within the meaning of Section 13 of the German Civil Code (BGB), they may, in the case of digital products, withdraw their contractual declaration within 14 days without stating any reasons in text form (e.g., by letter, fax, or email).
Exercise and Observance of the Right of Withdrawal
To meet the withdrawal deadline, it is sufficient to dispatch the withdrawal or the goods in good time. The withdrawal must be sent electronically via our contact form or by post to the following address:
Postal address for the withdrawal:
Rotfuß GmbH
Lessingstraße 7
74834 Elztal
Germany
Consequences of Withdrawal
In the event of an effective withdrawal, the mutually received benefits are to be returned and any benefits derived (e.g., interest) surrendered. Rotfuß GmbH shall bear the costs for sending the goods to the customer, specifically the shipping costs indicated in the customer's order.
If the customer cannot return the received performance in whole or in part, or only in a deteriorated condition, they must compensate us for the loss in value, if applicable. The customer only has to compensate for the deterioration of the goods to the extent that the deterioration is due to a handling of the goods that goes beyond the examination of their properties and functionality – such as would have been possible for the customer in a retail store. Furthermore, the customer can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the goods as if they were their property and refraining from doing anything that could negatively affect their value.
The customer must bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods. The return documents (e.g., a postage voucher from the postal company) can be provided upon request for a fee. Items that cannot be sent by parcel will be collected from the customer. Goods that can be sent by parcel are to be returned at the customer's risk.
Obligations to refund payments must be fulfilled within 30 days. The period begins for the customer upon dispatch of their declaration of withdrawal or the goods, and for us upon their receipt. Returns sent freight collect will only be accepted by us if we have given our prior consent.
The Right of Withdrawal Expires in the Following Cases
The right of withdrawal for the purchase of digital products expires if the customer has received the digital product from us (e.g., by email) or has begun downloading or streaming it. The prerequisite for this is that the customer has previously expressly agreed that we send them the product or enable the download or streaming before the expiry of the fourteen-day withdrawal period, and has confirmed their knowledge that their right of withdrawal expires through this consent.
The Right of Withdrawal Does Not Apply in the Following Cases
The right of withdrawal does not apply to the delivery of digital or physical products and goods that have been created according to customer specifications or are clearly tailored to the personal needs of the customer. The same applies to products and goods which, due to their nature, are not suitable for return, can spoil quickly, or whose best-before date has expired.
